Terms & Conditions

1. Acceptance of Terms and Conditions

Please read these Terms and Conditions carefully before using or obtaining any materials, information, products, or services through Case Care Services (Pty) Ltd “CCS” and or the Main Supplier as a potential customer “client/s”.

By accessing the CCS website and by purchasing any of our products, you agree to accept, without limitation or qualification, all these Terms and Conditions.

If you do not accept these Terms and Conditions, please do not proceed with any orders, and if so required, please exit the CCS website, as we cannot accommodate your request outside these terms and conditions.

2. Place an Order

CCS will only give the client product options and pricing via email.  It will be the responsibility of the client to review the specifications for suitability of use, CCS does not guarantee or warrant that the products and services match the specifications of the client’s enquiry or tender.
Pricing options will be given in writing only – via email, in a formal quote, on a CCS letterhead, and are RAND-based.

These prices exclude delivery, training, installation, and clearance costs.
Upon receipt by the client of this formal quote, please reply to the email from which the formal quote has been sent to confirm your order, only written orders can be accepted, this will include the acceptance of the CCS terms and conditions.

No order will be accepted that has not been preceded by a formal quotation on a CCS letterhead.

The Quotation is an overview of the sale and includes product name-/brand, specifications, colour, quantity, and any other specifics you require that we can offer. We might not be able to accommodate your request – so please make sure at this point, that your specific request for colour, quantity, size, dimensions, and or date of availability is correct.

3. CCS operates on a “Cash Sales” basis only

All Sales will only be processed upon cleared receipt of funds into Case Care Services (Pty) Ltd’s (“CCS”) nominated Bank Account, as per the details on the formal quotation.

Depending on the interbank transfer dates, this may take up to 48 hours, or 2 (two) working dates. On all Cash Sales, delivery, training, installation, and clearance costs are not included unless specifically stated in the quotation.

The estimated date of availability for collection or delivery is an estimation only – for locally (South Africa) manufactured goods, please allow 2-4 weeks to manufacture, and 3-5 days for dispatch from the warehouse.   For Imported goods, delivery dates may vary, depending on the Main Suppliers dispatching warehouse.  Manufacturing can take up to 8 weeks, and shipping up to 6 weeks. Dates of availability cannot be guaranteed. You will be frequently updated on your order.

4. Ownership

Risk of damage to or loss of the goods shall pass to the Customer:
in the case of goods to be collected from CCS’s premises, at the time when CCS notifies the Buyer that the Goods are available for collection;
or
in the case of the goods to be delivered, at the time of delivery.

Notwithstanding delivery and the passing of risk in the Goods, or any other provision of these Conditions, the property in the Goods shall not pass to the Customer until CCS has received cleared funds payment in full of the price of the goods.

5. Returns Policy

  • CCS warrants that the Goods will correspond with their specification at the time of collection or delivery and will be free from defects in material and workmanship.
  • Our products often carry a manufacturer’s warranty which provides protection against defective goods or malfunction.

CCS agrees to Returns for Credit and Exchanges, provided that the terms and conditions below are adhered to.

CCS reserves the right to cancel an order or not to accept any order, if there is not an agreement between CCS and the client to the terms and conditions as stated below and above.

If you do not agree with the Terms and Conditions of Sale, please do not proceed with the order. By confirming your order and by making an upfront payment, the client specifically confirms to have read and understood the terms as set out in this document and agrees to them.

No Cash Back for returns.

For this reason, we place a strong emphasis on the responsibility of the client to check and counter-check the quotation before accepting the quotation and paying for the order.

CCS agrees to Credit or Exchanges only, and only in the following circumstances, and under the following conditions:

  • There is a clear manufacturing fault or defect with the product purchased;
  • The proof of purchase can be presented;
  • Reported within 7 calendar days (or 5 work days) from receiving the purchase;
  • returned to CCS, at the client’s cost; and
  • in its original condition, and in or with its original packaging.

Please let CCS know within 7 calendar days (or 5 working days) of the manufacturing fault, via email on corne@casecareservices.co.za.

 Pictures or proof of manufacturing fault must please be supplied.

The costs of delivery and any additional packaging will be for the client’s account.

No Returns on Linen and made-to-order Steel Furniture or Imports

  • No returns or refunds will be available on our imported range of products;
  • No returns will be available on made-to-order locally manufactured items, including linen. In this instance, the Quotation will be a guiding document, before the order, and should include specifications like colour, dimensions, and other specifications the client may want to insist on. It will be the responsibility of the client to confirm any specifications including colour, size, quantity, or any other specifics that CCS should adhere to before processing the order. If the goods supplied match these specifications, or if no specifications are noted on the Quotation, no returns will be available.
  • On locally manufactured steel products, linen, and imports, credit will be issued for manufacturing faults only, and can be swapped for a similar product with no defect. These faults or defects must be brought to CCS’s attention within 7 days after receiving the order and returned in its original condition, including original packaging.
  • Cost of returns in all instances will be for the client’s account.
  • A 10% handling fee will be deducted from the original purchase price on all Sales.
  • For this reason, please familiarise yourself with the specifications and dimensions of goods before confirming your order, and especially on the suitability of use – as no cash-backs will be offered under any circumstances.

No credit or cash back will be available;

  • No Credit or Cash Refund will be available on delivery costs or courier costs, either of the original purchase and delivery or the return;
  • Return of goods will be at the cost of the client;
  • Exports: No refunds are available on exports

6. DAMAGED GOODS

  • CCS cannot take any responsibility for damaged goods at the time of delivery, this is the Transport Company’s responsibility and between the Customer and the Transport Company.
  • If the defect in the goods was caused due to abuse, fair wear and tear, or the customer’s/delivery company’s negligence, the warranty will no longer apply and the goods cannot be returned to us.
  • Customers will also not be able to return the goods to us if they did not follow the instructions of use or guidelines in any other printed material that we provided in
  • connection with the goods or if the goods were used for a purpose other than what it was intended to be used for.

7. Limitation of Liability

Neither CCS, nor any of our subsidiaries, divisions, affiliates, agents, representatives, or licensors shall be liable to our client, or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use, the Website, the Products, or any materials, opinions or recommendations of third parties on the Website. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage. In jurisdiction that does not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdiction shall be limited to the extent permitted by law.
